Terms and Conditions of the Service
1. Service Language
All Exploramar Diving services are offered in Spanish and English. If you require assistance in another language, please contact us in advance to confirm availability.
2. Reservations and Payments
- Daily Tours (Individual Passengers):
- Advance bookings: 50% deposit required up to 60 days before the service date.
- Last-minute bookings: 100% payment required at least 48 hours before the service date.
- Complete Tour Packages and/or Charters:
- 50% deposit required at least 5 months before the service start date.
- Bookings made by travel agencies, tour leaders, or third parties:
- 50% deposit required at least 5 months in advance.
In all cases, the remaining balance must be paid at least 30 days before the service date.
Payments are accepted in U.S. dollars via cash, bank transfer, or credit card.
3. Cancellations and Refund Policy
For direct bookings, all cancellations and refunds must be managed with the general management of Exploramar Diving.
For bookings made through third parties (agencies/tour leaders), refunds must be requested directly from the entity that processed the payment.
Refunds for Daily Tours:
- 31+ days before: Full refund
- 15 to 30 days before: 50% penalty
- 0 to 14 days before: No refund
Refunds for Complete Tours or Charters:
- 61+ days before: Full refund
- 15 to 60 days before: 50% penalty
- 0 to 14 days before: No refund
These policies apply even in cases of illness, social unrest, political events, or natural disasters. In verified exceptional cases, the company may offer:
- Date change.
- Credit toward other services.
No refunds will be issued for unused services due to voluntary withdrawal once the service has begun.
Exploramar Diving reserves the right to modify itineraries for safety reasons or due to weather or ocean conditions.
4. Tour Capacity
The maximum capacity per vessel established by Machalilla National Park is 16 passengers.
For diving tours, the maximum capacity is 8 passengers per vessel.
5. Passenger Acceptance
Exploradiving S.A. reserves the right to deny participation to individuals whose behavior may jeopardize group safety or violate park regulations. This includes, but is not limited to:
- Intoxication.
- Aggressive or inappropriate conduct.
- Violation of local or environmental regulations.
By booking a service, passengers declare that they are in good physical and health condition to engage in marine activities. All participants must sign a liability waiver prior to beginning any activity.
6. Insurance and Physical Conditions
All international passengers participating in scuba diving activities must have travel insurance that includes coverage for underwater activities.
Exploramar Diving is not responsible for medical complications resulting from pre-existing health conditions.
7. Luggage
Limits on weight, size, or number of bags per passenger may apply.
If the service includes air transportation, IATA regulations will be enforced.
8. Tour Leader Discounts (Applies to Isla de la Plata Hiking Tours Only)
- Groups of up to 6 people: Tour leader pays full rate
- Groups of 7 to 9 people: Tour leader pays 50%
- Groups of 14 or more: Tour leader joins free of charge
9. Limitation of Liability
Exploradiving S.A. is not responsible for losses, accidents, damages, delays, or expenses caused by third parties or events beyond its control, including but not limited to:
- Adverse weather conditions
- Port or road closures
- Natural disasters
- Flight cancellations
